CORPORATE GENERAL CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA

YMS Yıldız İnşaat Malzemeleri İmalat Sanayi ve Tic. Ltd. Şti. (“YMS Yıldız”); within the scope of our activities arising from the Personal Data Protection Law No. 6698 (“KVKK”) and the relevant legislation and legal regulations, we have prepared this clarification text to inform our Visitors, Online Visitors, Customers, Potential Customers, Supplier Employees and Supplier Representatives regarding the processing, storage and transfer of your personal data.

1) What Categories of Personal Data Do We Process and For Which Purposes Do We Process Them?

Your personal data may be processed by YMS Yıldız in accordance with the principles set forth in Article 4.2 of the KVKK;

  1. Being processed lawfully and fairly,
  2. Being accurate and, where necessary, up to date,
  3. Being processed for specific, explicit and legitimate purposes,
  4. Being relevant, limited and proportionate to the purposes for which they are processed,
  5. Being retained for the period stipulated in the relevant legislation or required for the purpose for which they are processed,

within the scope of our established and ongoing business relationships with our business partners, and provided that a person may fall into more than one category, for the purposes stated below.

A. Our Visitors

Physical premises security information of our visitors, such as camera recordings;

  1. Creating and tracking visitor records,
  2. Ensuring physical premises security.

B. Our Online Visitors

Transaction security information of our online visitors using our website, such as your IP address; marketing information, such as cookie records; and, if you provide them to us, identity information, such as your name and surname; and contact information, such as your e-mail address;

  1. Conducting activities in compliance with the legislation,
  2. Carrying out information security processes,
  3. Following up requests and complaints,
  4. Carrying out communication activities,
  5. Providing information to authorized persons, institutions and organizations,
  6. Enabling your access to our website via the internet.

Identity information, contact information, customer transaction information, such as order information; physical premises security information, financial information, such as balance sheet information; legal transaction information and marketing information, such as shopping history information, of our individual customers or the representatives and/or employees of our corporate customers;

  1. Conducting activities in compliance with the legislation,
  2. Carrying out finance and accounting affairs,
  3. Carrying out/supervising business activities,
  4. Carrying out logistics activities,
  5. Carrying out after-sales support services for goods/services,
  6. Carrying out sales processes for goods/services,
  7. Conducting marketing analysis studies,
  8. Carrying out contract processes,
  9. Providing information to authorized persons, institutions and organizations,
  10. Ensuring physical premises security,
  11. Resolving legal disputes,
  12. Carrying out storage and archiving activities,
  13. Carrying out risk management processes,
  14. Carrying out loyalty processes regarding the company/products/services,

D. Our Potential Customers

Identity information, contact information, customer transaction information, physical premises security information and marketing information of our individual customers or the representatives and/or employees of our corporate customers;

  2. Carrying out contract processes,
  3. Ensuring physical premises security,
  4. Conducting marketing analysis studies.

E. Our Supplier Employees

Identity information, contact information and physical premises security information of our supplier employees;

  1. Carrying out communication activities,
  2. Carrying out/supervising business activities,
  3. Ensuring physical premises security,
  4. Carrying out supply chain management processes,
  5. Carrying out logistics activities,
  6. Conducting activities in compliance with the legislation,
  7. Carrying out occupational health and safety activities.

F. Our Supplier Representatives

Identity information, contact information, physical premises security information, customer transaction information, financial information, marketing information and legal transaction information of our individual suppliers or the representatives of our corporate suppliers;

  1. Carrying out/supervising business activities,
  2. Carrying out procurement processes for goods/services,
  3. Carrying out finance and accounting affairs,
  4. Carrying out contract processes,
  5. Carrying out investment processes,
  6. Ensuring physical premises security,
  7. Following up and carrying out legal affairs.

2) What Are the Methods of Collecting Your Personal Data?

Your personal data specified above in categories is collected through physical means such as order forms, contracts and visitor forms, or through information systems and electronic devices, such as telecommunication infrastructure, computers and phones; third parties, such as KKB and Findeks; our website and other documents declared by the relevant person, by automatic or non-automatic means.

3) What Is the Legal Basis for Collecting Your Personal Data?

Your personal data is processed by YMS Yıldız for the purposes explained above based on the legal grounds stated in Article 5 of the KVKK, namely;

  1. It is explicitly stipulated by laws,
  2. It is necessary to process personal data of the parties to a contract, provided that it is directly related to the establishment or performance of a contract,
  3. It is mandatory for the data controller to fulfill its legal obligation,
  4. Data processing is mandatory for the establishment, exercise or protection of a right,
  5. Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

4) Do We Transfer Your Personal Data to a Third Party?

  1. Personal data belonging to our visitors may be shared with law enforcement authorities and judicial authorities for the purpose of resolving legal disputes and upon request in accordance with the relevant legislation.
  2. Personal data belonging to our online visitors may be shared with judicial authorities and authorized public institutions and organizations for the purpose of resolving legal disputes and upon request in accordance with the relevant legislation.
  3. Personal data belonging to our customers is transferred, within the scope stipulated by legal regulations, to authorized public institutions and organizations for the purposes of conducting activities in compliance with the legislation, following up and carrying out legal affairs, and providing information to authorized persons, institutions and organizations; and to IT companies, suppliers, cargo companies, insurance companies, banks and our financial advisor for the purposes of carrying out/supervising business activities and carrying out risk management processes. In addition, such personal data may be transferred to the law office from which we receive services and to judicial authorities in order to be used as evidence in potential future legal disputes.
  4. Personal data belonging to our potential customers may be transferred to the law office from which we receive services and to judicial authorities in order to be used as evidence in potential future legal disputes.
  5. Personal data belonging to our supplier employees is transferred, within the scope stipulated by legal regulations, to authorized public institutions and organizations, IT companies, suppliers, cargo companies, banks and our financial advisor for the purposes of conducting activities in compliance with the legislation, following up and carrying out legal affairs, providing information to authorized persons, institutions and organizations, and carrying out/supervising business activities. In addition, such personal data may be transferred to the law office from which we receive services and to judicial authorities in order to be used as evidence in potential future legal disputes.
  6. Personal data belonging to our supplier representatives is transferred, within the scope stipulated by legal regulations, to authorized public institutions and organizations, IT companies, suppliers, cargo companies, banks and our financial advisor for the purposes of conducting activities in compliance with the legislation, following up and carrying out legal affairs, providing information to authorized persons, institutions and organizations, and carrying out/supervising business activities. In addition, such personal data may be transferred to the law office from which we receive services and to judicial authorities in order to be used as evidence in potential future legal disputes.

5) Do We Transfer Your Personal Data Abroad?

As YMS Yıldız, we do not transfer your personal data abroad.

6) How Can You Exercise Your Rights Regarding Your Personal Data?

You may submit your requests within the scope of Article 11 of the KVKK, which regulates the rights of data subjects, to YMS Yıldız through the “Data Controller Application Form” prepared for your convenience in accordance with the “Communiqué on the Procedures and Principles of Application to the Data Controller” available at www.ymsyildiz.com.tr.
